RB Media Solutions provides services to clients all around the world. RB Media Solutions has the responsibility to protect each client and provide them with the best services available. The following guidelines were designed to insure these services.

Content: All services provided by RB Media Solutions may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret or other statute. The subscriber agrees to indemnify and hold harmless RB Media Solutions from any claims resulting from the use of the service which damages the subscriber or any other party.

NOTE: We do allow adult sites, provided that the content thereof is in compliance with 18 U.S.C. 2257 , and with 28 CFR 75 .

Examples of non-acceptable content or links

• Pirated software
• "Illegal MP3's"
• Hackers programs or archives
• Warez Sites
• Child Pornography
• Scripts for sending any kind of bulk email

  RB Media Solutions will be the sole arbiter as to what constitutes a violation of this provision. Unlimited Traffic/Hits & Server Resource Usage: RB Media Solutions is pleased to offer our clients unlimited traffic/hits, and server usage. Unlimited Traffic/Hits refers to the number of visitors to your website, NOT the amount of bandwidth/data transfer. Your account is still limited to the alotted bandwidth/data transfer included with your selected package. To maintain the integrity of our service the following traffic/usage limitations apply.

• Sites with banners, graphics or cgi's running from their domain being used on other domains.
• Sites with immense graphic archives or galleries.
• Sites offering immense download archives, such as .zip, .tar, .ra and .GZ.
• Sites running large chat room gatherings.
• Sites using more than 20% of system resources
  If you do not qualify for unlimited traffic/hits, your account may be required to be upgraded, or, RB Media Solutions may move your site to a different server, to reduce the load on the server you are currently residing... RB Media Solutions will be the sole arbiter as to what constitutes a violation of usage limitations. Bandwidth/data transfer will go unmonitored until you reach your account limit, then normal over-usage data transfer costs will apply. At any time RB Media Solutions may move your site to a different server, to reduce the load on the server you are currently residing...

  Chat Rooms: RB Media Solutions does allow clients to install their own chat rooms. These tend to be large system hogs and may fall into the usage limitations clause. We do, however, provide an html based cgi chatroom that runs without hindering the performance of the machine for others. You are free to run your own chat script, as long as it does not hinder server performance.

  Background Processes/Programs: RB Media Solutions may allow programs to run continually in the background, these are considered on a one to one basis and an extra charge may be incurred based on system resources used and operational maintenance needed.

  Cron Jobs: RB Media Solutions does allow Cron Jobs to be conducted on our servers.

  IRC: RB Media Solutions currently does not allow IRC or IRC bots to be operated on our servers.
  
  Multiple Connections: RB Media Solutions does not allow multiple dial-in connections on a single dial-up access account. Multiple telnet and ftp sessions are allowed, on a single hosting account.

  Idle Timeouts: RB Media Solutions may disconnect any idle connection to the network. Average timeouts are:
  FTP - 300 seconds
  Dial-Up - 10-15 minutes
  Telnet - 2 hours

  Commercial Advertising - Email: Spamming, or the sending of unsolicited email, from an RB Media Solutions server or using an email address that is maintained on an RB Media Solutions machine is STRICTLY prohibited. For general reference, we consider spam any email that is sent to more than 10 people at a time that did not ask for it to be sent to them. More specifically, spam has any of the following characteristics...

• an email which attempts to disguise its source
• an email that was not solicited by its recipient
• an email that does not provide the recipient a way to unsubscribe with a single click.

  Mail can not be sent using any kind of mailing script other than what RB Media Solutions has provided. Any account found to have such a script, regardless of whether that script is in use, shall be immediately deleted. In addition, sites selling or promoting bulk email, or even linking to sites that sell or promote it, are prohibited. RB Media Solutions will be the sole arbiter as to what constitutes a violation of this provision.

  RB Media Solutions Services are Intended for the End User Only: Customers cannot sublease, subhost, or give away control of any portion of RB Media Solutions Network's resources. For customers needing more than one website, we have provided a very simple means to add new sites to your account. We do have a generous reseller program available if you wish to resell our services.

  By submitting a credit card, User agrees to authorize all recurring charges to the account and any other balances incurred due to overages of limits, additions or extras to the account, service charges and/or any other fees. User will not receive a refund for any setup fees or any fees other than the monthly recurring hosting fees. User will not receive a refund for any other reason, including but not limited to:

• late or incorrect cancellation
• unused time
• slow connection caused by client's ISP/network
• client's ignorance
• InterNIC delays
• already having logged in to his or her account many times
• having used the account for whatever reasons or purposes, or account termination for violation of policies.

  RB Media Solutions reserves the right to terminate this agreement, and to delete the Website from its hardware immediately upon the occurrence of any of the following events:

• Non payment of any charges due from User.
• Breach of any term or condition of this agreement by User.
• Commencement of any lawsuit or proceeding against User arising from or relating to its use of the Website, whether or not such suit names Provider as a party or seeks any recovery from RB Media Solutions.

  FINES AND FEES

  Spam Fee: Each instance of verifiable spam will result in

• Immediate suspension and/or deletion of all accounts held by Customer.
• A $500 FINE .
• Full accountability for any damages RB Media Solutions may suffer as a result, including damages to our equipment, our network, or our reputation.
  In addition, we reserve the right to permanently delete all associated websites and their backups, and to permanently ban the Customer from using our services.

  Domain Name Record Modifications: Domain name record modifications are free and unlimited.

  Declined Transactions: Customer agrees to keep credit card information up-to-date. Customer agrees to pay a $0.35 fee every time Customer's financial institution declines a transaction, not to exceed $0.70 per day and not to exceed $10.00 per month.

  Late / Reinstatement Fees: Any payment received after 8:00 PM E.S.T. on the due date will be considered late, and the account will be immediately suspended. Late payments are subject to a $7.50 late fee. If the original payment due AND the late fee are not paid within 72 hours, the account will be deleted from our servers. To reinstate an account, all delinquent fees AND a $15.00 reinstatement fee must be paid up front.

  Failure to Cancel Account: If Customer fails to cancel an account, the account will still be charged normal hosting fees, late/reinstatement fees, and any other fees that would normally be assessed up to and following account deactivation/deletion. Customer agrees to pay these fees regardless of whether or not the account was actually used. The fees will stop being assessed only when the customer formally requests that the account be canceled. Every month that a delinquent account remains open (has not been formally canceled), and in which no payments are received within 72 hours from the due date, will be assessed a $35.00 non-payment fee. This fee is charged regardless of whether or not the site has been deleted from our servers, up until the date the account is formally canceled.

  Chargeback Fee: If a credit card was charged in error, and we are unable to prove otherwise, we will cheerfully refund the amount. However, if we are not given a fair chance to prove otherwise, Customer will be fined a $50.00 fee for initiating a chargeback, regardless of whether or not said chargeback goes through. In other words, Customer agrees to ALWAYS contact us prior to disputing a charge with their financial institution. In the event a charge is disputed, we reserve the right to immediately delete all of the Customers' accounts, and to freeze all domains held by us until this fee has been paid by a certified check or money order.

  Collection: If an outside organization is used to collect a delinquent amount from Customer, all outstanding debts will be reported to all applicable credit bureaus. Reports will also be sent to one or more agencies that exist to protect companies providing internet services. Customer understands that being listed with one of these agencies could result in refusal of service from many reputable internet services companies. In addition, customer agrees to pay all costs incurred by RB Media Solutions relating to the collection of the delinquent amount owed by Customer, including attorney's fees, court costs, travel expenses, and any and all other expenses incurred by RB Media Solutions to collect the delinquent amount.

  Credit Card Fraud and other illegal violations: We do our best to make the internet a safe marketplace. As such, RB Media Solutions will prosecute anyone committing credit card fraud to the fullest extent of the laws of their land. It does not matter what country they live in. We have worked, and will work with local law enforcement agencies in any country to track down those responsible.

  Server Abuse: Any attempts to undermine or cause harm to a server is strictly prohibited, and will be fined accordingly.

  Refusal of Service: We reserve the right to refuse or cancel service at our sole discretion.

  Terms and Termination: User has 30 days from date of account setup to be eligible for a full refund. All refunds requested with a valid complaint will receive a refund of the charge periods. Specifically from beginning of sign up to month's end and following charged months if the beginning of the month and its charge have fallen in the 30 day period. What constitutes valid complaint shall be determined by RB Media Solutions in its sole and absolute discretion. No refund will be given on setup or one time fee's for any reason.

  Disclaimer: RB Media Solutions will not be responsible for any damages your business may suffer. RB Media Solutions makes no warranties of any kind, expressed or implied for services we provide. RB Media Solutions disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by RB Media Solutions and its employees. RB Media Solutions reserves the right to revise its policies at any time without prior notification.
